Minutes of the Management Committee Meeting at the Victory Club Cheltenham
on Wednesday 3rd January 2007.

As the Chairman and both Vice-Chairmen were unable to attend the meeting,
Mr Les Fisher was unanimously elected to chair the meeting.
Minutes of the meeting held on Wednesday 29th November 2006 were read
and accepted
Matters Arising from the minutes.
The Secretary informed the meeting that, as far as he was able to ascertain,
no action had yet been taken by the GFA against the individual who was
alleged to have perpetrated the head butt in the Division 4 match between
Whaddon United and Elmbridge Old Boys at the end of November. The Secretary
did confirm, however, that a referee's report card had now been received
from the match day official, substantiating the fact that the player had
been dismissed for a head butt and that the matter had been reported to
the GFA.
Appeal - Andoversford Nomads
Details of the basis under which Andoversford Nomads had registered an
appeal against the fines imposed upon them at the meeting held on November
29th, for transgressions of rule 13(j), had been distributed to the members
of the committee in advance. The General Secretary gave a brief overview
of the synopsis of the situation.
It was explained that Andoversford Nomads had failed to provide an Official
Match Referees Result card for their Senior Charity Cup match with Prestbury
Rovers on Saturday, 16th October, 2006. The meeting was informed that
Andoversford Nomads had sent a letter to the League Results Secretary
explaining that the card was missing as the match referee, Maurice Davies,
had left the ground without returning the card. Andoversford Nomads went
on to speculate, in their letter, that this may have been because there
had been a dispute about the fees that were payable to the referee.
The General Secretary then explained that the next course of action in
such matters is always to check with the referee. This was not possible
for a number of weeks as Mr Davies was on holiday. However, when he returned,
he confirmed to Mr Arthur Stiley, the Referee's Secretary, that he had
not been provided with a referee's card on the day in question. The General
Secretary informed the meeting that, as a consequence of receiving this
information, Andoversford Nomads were suspended immediately. This suspension
was lifted before their next game, because they took actions to rectify
the situation, but they were charged with rule offences under the provisions
of rule 13(j).
This action, as confirmed at the meeting of November 29th, lead to the
appeal and Mr Phil Hendy, the secretary of Andoversford Nomads, was asked
to attend the meeting to put forward the case for his club.
Mr Hendy informed the meeting that he had given the Official Referees
Result Card to Mr Davies before the match in question. He continued by
saying that, after the match, there had been a delay of some two or three
minutes before he approached Mr Davies, time which was used to consider
the claim for expenses that had been made by the Referee. Mr Hendy then
told the meeting that, when he then paid the official, he discovered that
he was ready to leave and this he did immediately after receiving his
fees. It was only after this that Mr Hendy realised that the card had
not been returned. Mr Hendy explained to the meeting that he did not feel
it appropriate to ring up the referee and ask him for the card, especially
in light of the disagreement that had been experienced with regard to
the expenses that were payable. Alternatively, he wrote a letter to the
League's Result Secretary, detailing the fact that the referee had left
the club with the card and without returning it to himself and using this
as mitigation for the fact that the card had not been forwarded to the
League. He further explained that he had also emailed a copy of this letter
to the General Secretary on 16th October and he brought the meeting's
attention to the fact that, in the course of this letter and email, he
expressed his concern that he was uncertain about how to proceed and that
he had asked for further advice.
Mr Hendy then informed the meeting that the next communication he received
from the League was at the beginning of November, when he was informed,
by email, of the fact that the club had been suspended from the League
as the Referee had failed to corroborate Andoversford Nomad's version
of events. He expressed his dismay and disappointment with this decision,
particularly as he had asked for advice and none had been forthcoming.
He stated that he believed that he should have been advised, on October
16th, that he needed to recover the card from the referee as this would
then have avoided the club not only being suspended from the League but,
also, subsequently accruing two £10 fines.
The General Secretary explained that, in all circumstances in which a
club provided mitigation for the non arrival of an Official Referees Report
Card, the immediate benefit of the doubt was always afforded to the club.
He emphasised the fact that action was never taken against a club immediately
in such circumstances. The General Secretary then went on to explain that
it was common practice for no further contact to be made with the club
and for the League to seek corroboration of the mitigation used from the
referee as soon as was practically possible. It was explained to Mr Hendy
that, unfortunately, in this instance the time taken for this process
to be put in place meant that Mr Davies could not be contacted until he
returned from holiday at the beginning of November. It was pointed out
to Mr Hendy that, when Mr Davies was asked about events of October 14th,
he gave an entirely different version to the one provided by Andoversford
Nomads. It was further explained that it was League policy to act on all
information received from referees registered with, and appointed by,
the League and that this was the reason why, at this juncture, Andoversford
Nomads were suspended from the League.
Mr Hendy assured the meeting that he had, indeed, handed the card to the
referee but accepted that he had failed to recover it from the referee
after the match. He reiterated the fact that he had asked for help in
his communications of October 16th and also confirmed that he made no
further attempts to contact any League officer between that date and the
receipt of the notification of suspension. After further discussion, Mr
Hendy was asked to leave the room whilst the committee considered the
appeal.
After a brief debate, during which it was confirmed that Mr Davies had
not left to go on holiday until after October 21st, it was decided that
the appeal against the fine imposed for the failure of Andoversford Nomads
to dispatch an Official Referees Result Card to the League within 10 days
of the match would be upheld. It was also decided, however, that the appeal
against the fine imposed for a failure to send an Official Referees Result
Card to the League within 5 days of the match would not be upheld. This
decision was communicated to Mr Hendy; along with the fact that it had
been agreed that Andoversford Nomads' appeal fee would be returned. As
this took the form of a cheque for £10, Mr Hendy asked if this could
be used as payment for the fine that remained in place and this was agreed.
It was then confirmed that this matter was now closed.

The League's Assistant Treasurer disagreed with assertions made in the
email but it was confirmed that this matter was now closed
Letter from Keith Clark, Chairman of Churchdown Panthers, responding the
League's concerns about the dual role of Trevor Middlecote, Secretary
of Churchdown Panthers and manager of FC Electrics Reserves in Division
Five. Mr Clark concludes by informing the League that he will assume responsibility
for the Secretary's duties with regard to Churchdown Panthers Cheltenham

Email from Broadway United explaining the circumstances in which their
Div 3 match with Charlton Rovers, scheduled for 16th December, was called
off and the fact that the referee, M Murray, still attended the fixture.
Mr Arthur Stiley, the League's referee's secretary, provided details of
the background to the circumstances in which Mr Murray had attended this
fixture, after which the committee confirmed that it would regard this
matter as closed unless any further correspondence was provided to the
contrary.
Email from Charlton Rovers, bringing the League's attention to the difficulties
that the club believes have been caused by the League's decision to play
on December 23rd, especially as this was exacerbated by the Cheltenham
Borough Council's decision to close all grounds except King George V playing
fields.

when setting up fixtures at the beginning of the season and the fact that
the League was not informed of Cheltenham Borough Council's intentions

The Committee noted the concerns expressed by Charlton Rovers and endorsed
the reply sent by the General Secretary
Letter from Endsleigh registering their dissatisfaction with the decision
taken by the match referee for their home Charity Cup match with Shipton
Oliffe on Saturday, 16th December, 2006. Endsleigh explain that they did
not feel that the pitch was playable, that Shipton Oliffe agreed and that,
as a result of the match being played, significant damage was inflicted
on the pitch which will now require substantial funds to rectify.
It was agreed that this matter would be afforded more consideration at
the next meeting, once the General Secretary had been able to circulate
copies of the letter from Endsleigh to all Committee Members.
Letter from Charlton Kings registering a protest against the decision
of the Management Committee to fine the club £15 for a late result
at the meeting of 29th November. Charlton Kings claim that they should
not have been fined £15 under rule 11(b) as they regarded this as
their first transgression of this rule this season.
The General Secretary informed the Committee that he thought it likely
that Charlton Kings had been fined once too often at the beginning of
the season and, consequently, the meeting agreed that the appeal should
be upheld. Mr Les Fisher, the League Treasurer, confirmed that Charlton
Kings had not paid the fine associated with the rule offence reported
to the meeting of 29th November. It was agreed that the fine imposed for
this rule offence should be reduced to £10 and that the appeal fee
deposited by Charlton Kings, which would otherwise have been returned
to them, would be used to cover the revised fine.

Whaddon United Res v Elmbridge Old Boys, Div 4, Sat 25/11/06: Referee
D Watts reports that details of a head butting incident have been forwarded
to the GFA.
It was noted that this card had now been lodged with the League and it
was confirmed that the League would consider this matter further once
details of the actions taken by the GFA, if any, in this case were available.
Whaddon United v AC Olympia, Div 3, Saturday 16/12/06: Referee M Malin
reports unacceptable abuse from Whaddon players towards him after the
match.
The General Secretary was instructed to write to Whaddon United and to
require them to provide a report on the incidents that occurred at the
end of this match.
Belmore Jags Reserves v Tewkesbury Dynamos, Div 3, Saturday 16/12/06:
Referee W Gibbard reports that the changing rooms at Naunton Park Rec
were unopened but that both sides agreed to play anyway. He reports further
that the changing rooms were still unopened after the game.
This was noted
Phoenix United v Smiths Athletic Reserves, Div 3, Saturday 16/12/06: Referee
M Ball reports that he was compelled to change in a toilet and that there
was a pungent smell emanating from the wet mud in one of the goalmouths.
He states that this smell resembled sewage and that he believes that the
source of the smell might be dangerous to players' health.

Endsleigh v Shipton Oliffe, Senior Charity Cup, Saturday 16/12/06: Referee
M Lytheer reports that he was made very welcome by the home club and that
the decision was made to play the game even though conditions were far
from ideal. He further reports that the pitch was very wet, heavy and
cut up under foot but that he deemed it safe and playable on a bright
sunny day.
It was agreed that the report provided by the referee for this match would
be considered at the next meeting in association with the letter received
from Endsleigh and which had already been deferred.
Cheltenham Civil Service IV v Cleevonians, Div 5, Saturday 23/12/06: Referee
A Smith reports at length that this game was abandoned in the 84th minute
when he showed the red card to two players associated with Cheltenham
Civil Service, for foul and abusive language, who then refused to leave
the field of play.
The contents of the report from Mr Smith were read to the meeting, as
was a report prepared by Cheltenham Civil Service. Mr Arthur Stiley, the
Referee's Secretary, informed the meeting that, to his knowledge, the
details of the cautions issued and dismissals administered had been reported
to the GFA. It was agreed to await the outcome of the GFA's disciplinary
procedures before considering this matter further. In addition, the General
Secretary was asked to write to both Cheltenham Civil Service and Cleevonians
to request further information.
The following details, with regards to the number of cards received from
referees for each match day, were also reported to the meeting.

Having decided, at their discretion as stipulated by League Rule 5(H),
that the fine for Belmore Jags' failure to adhere to the specific requirements
placed upon them, at the meeting of October 25th, would be £50,
the Management Committee was reminded that a suspended fine of £200
had been imposed upon the club at the meeting held on September 5th. It
was pointed out to the meeting that this fine had been imposed for gross
mal-administration, with the intention that it would cease to be suspended
should there be any further instances of gross mal-administration this
season. Following debate, it was decided that Belmore Jags' failure to
hold regular committee meetings and to immediately dispatch the minutes
of such meetings to the League, in direct contravention of the requirements
placed upon them at the Management Committee meeting held on October 25th,
constituted gross administration. As a consequence, it was unanimously
agreed that Belmore Jags be required to pay the previously suspended fine
of £200 forthwith, in addition to all other fines incurred by the
club.

Following the completion of the Committee's considerations of Rule Offences,
it was unanimously agreed that Standing Orders should be suspended to
allow the meeting to continue beyond 9.00 pm
Fixtures
John Hunt, the League's Assistant Secretary, informed the meeting that
he had re-arranged 47 fixtures over the course of the Christmas period
and that there were still 11 more matches outstanding that needed to be
rescheduled. He explained that these games had previously been cancelled
because of cup commitments and the intervention of the weather.
He also reported that there had been two abandonments. The first of these
was the game between Cheltenham Civil Service IV and Cleevonians, which
had previously been discussed when the committee considered Referee's
Reports. It was noted that it had already been agreed that a decision
on this game would be taken at a later date. The second abandoned game
was the Division Five fixture between Southside and Churchdown Panthers
on December 23rd. A report had been received from Southside explaining
that this match was abandoned after 19 minutes play, at which juncture
a serious injury had been sustained by a Southside player. The score at
this stage had been 0-0. It was unanimously agreed that this game should
be replayed in its entirety.
Mr Hunt then reported to the meeting that he had received three requests
from clubs to cancel fixtures because of Stag weekends. After consideration,
the Committee agreed to Bishops Cleeve's request to cancel their Division
3 fixture with Tewkesbury Dynamos on January 27th and Kings request to
cancel their Division One game with Winchcombe Town on February 24th.
However, Bredon's request to cancel their Minor Charity Cup match on January
20th was not agreed.
Mr Hunt concluded by bringing the meeting's attention to the fact that
he still had not received any County Cup fixtures from the GFA and that
he was still reliant on these fixtures being passed to him by other officers
of the League. Mr Arthur Stiley assured the meeting that he would raise
this issue once again with the GFA County Cup committee when it next met.
Charity Cup Sub Committee.
The report produced from the meeting of the Charity Cup Sub Committee,
which had been held on Wednesday, December13th, 2006, had been distributed
in advance. The General Secretary took the meeting through the salient
points and particularly highlighted the two rule changes that the sub
committee had recommended. Copies of the alterations to the rules in question
were distributed to Committee members and the rationale behind the changes
was explained.
It was unanimously agreed to accept both the recommendations for rule
changes and the rest of the report as a whole
Clubs Meeting
The General Secretary asked Committee members to let him have any items
that they required for the agenda for the clubs meeting on January 31st
by January 17th at the latest. He also informed the meeting that he intended
to detail the working practice of the league with regard to rule offences
and to highlight the need to utilise the appeals process.
The General Secretary also asked the Registrations Secretary to bring
his supply of League forms and cards so that clubs might be able to replenish
their stocks as necessary
Any Other Business:
Mr Arthur Stiley, the League's Referee's Secretary, reported to the meeting
that several people had informed him that Mark Davies had been acting
as a linesman or, when no official referee was present, a referee for
Andoversford Nomads on occasions during the first half of the season.
Mr Stiley reminded the meeting that the League's Management Committee
had banned Mr Davies from acting in an official capacity in Cheltenham
League matches but felt that Andoversford Nomads were probably unaware
of this. The General Secretary was asked to write to Andoversford Nomads
to point out the fact that Mr Davies was not permitted to act as either
Referee or Linesman for any match under the jurisdiction of the Cheltenham
League.
Mr John Hunt, the League's Assistant Treasurer, raised concerns about
the number of items of League Correspondence, sent by member clubs, that
seemed to be lost in the post. It was agreed that this issue should be
raised at the Club's Meeting on January 31st.
Mr Les Fisher informed the meeting that several clubs had been advised
that it was not necessary to complete triplicated teamsheets for Charity
Cup matches. Mr Fisher pointed out that, following a change of rule at
the last AGM, all teams were now required to complete triplicated team
sheets for Charity Cup matches.
The General Secretary asked Committee Members to let him have the details
of any rule changes that they might want to propose to the Annual General
Meeting by the date of the next meeting. He explained that this would
then allow him to submit the details of the rule changes to the GFA League
Sanctions and Rules Revision Committee when they next meet at the end
of February.
The report prepared by the General Secretary into the renovated facilities
at Kingsmead School, and which recommended them as being suitable for
Cheltenham League matches, was adopted unanimously.
